Article 1 – Definitions

In these terms, the following definitions apply:

Cooling-off period: the period during which the consumer can exercise their right of withdrawal;
Consumer: the natural person who is not acting for purposes related to their trade, business or profession and enters into a distance contract with the entrepreneur;
Day: calendar day;
Duration transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time;
Durable data carrier: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Model form: the withdrawal form made available by the entrepreneur;
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
Distance contract: a contract concluded exclusively using one or more means of distance communication;
Means of distance communication: a method used to conclude a contract without the consumer and entrepreneur being physically present together;
General Terms and Conditions: the present terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer of the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer.

Before concluding the contract, these terms are made available to the consumer. If this is not reasonably possible, it will be indicated where they can be viewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the terms will be made available in a way that allows easy storage on a durable data carrier.

If any provision is invalid, the remaining provisions remain in force.

Article 4 – The offer

If an offer has a limited validity or is subject to conditions, this will be explicitly stated.

The offer is non-binding and may be changed.

Descriptions of products and/or services are as accurate as possible. Images are a true representation, but colors may vary slightly.

Obvious mistakes or errors do not bind the entrepreneur.

Article 5 – The agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions.

In case of electronic acceptance, the entrepreneur will confirm receipt.

The entrepreneur ensures appropriate security measures for electronic data transfer and payments.

The entrepreneur may refuse orders if there are valid reasons.

Article 6 – Right of withdrawal

When purchasing products, the consumer has the right to withdraw from the agreement within 14 days without giving any reason.

The cooling-off period starts the day after receiving the product.

During this period, the consumer must handle the product and packaging with care.

Article 7 – Costs in case of withdrawal

The costs of returning the product are borne by the consumer.

Any paid amounts will be refunded within 14 days, provided the product has been received.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal may be excluded for:

  • custom-made or personalized products
  • items that cannot be returned due to their nature
  • perishable goods
  • sealed products for hygiene reasons once opened

Article 9 – The price

Prices remain unchanged during the validity period, except for VAT changes.

All prices include VAT.

Printing and typographical errors are reserved.

Article 10 – Conformity and warranty

The entrepreneur guarantees that products meet the agreement and reasonable quality standards.

Statutory warranty applies to all products.

Defects must be reported within 2 months.

Article 11 – Delivery and execution

Delivery takes place at the address provided by the consumer.

Orders are executed as quickly as possible, but no later than 30 days unless agreed otherwise.

In case of delays, the consumer will be informed and may cancel the agreement.

Article 12 – Duration transactions

Consumers may terminate agreements with a notice period of up to one month.

Automatic renewal is only allowed under certain conditions.

Article 13 – Payment

Payments must be made within 7 working days unless otherwise agreed.

Incorrect payment details must be reported immediately.

Article 14 – Complaints procedure

Complaints must be submitted within 2 months after discovering the issue.

The entrepreneur responds within 14 days.

If no solution is reached, disputes may be handled via WebwinkelKeur or the EU ODR platform.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law.

The Vienna Sales Convention does not apply.

Article 16 – Additional provisions

Additional or deviating provisions may not disadvantage the consumer and must be recorded in writing or in a storable format.
